Haiti TPS Status Tracker

Last verified: October 2026

Where things stand

TPS for Haiti ended on July 27, 2026. The Supreme Court ruled on June 25, 2026 (Mullin v. Doe) that Department of Homeland Security decisions to terminate TPS are not reviewable by the courts — and the termination took effect a month later.

Work permits (EADs) tied to Haitian TPS were invalidated the same day. If your employment authorization came from TPS, it is no longer valid — continuing to work on it carries real risk.

An estimated 330,000–350,000 people are affected. Deportation flights began on August 20 and August 27, 2026.

On October 5, 2026, the Supreme Court vacated a Ninth Circuit ruling that had favored TPS holders and sent the case back down. Litigation is still moving — but it has restored nothing yet.

Bills exist in Congress — S.4814, and H.R. 1689 which passed the House in April 2026 — but Senate passage is unlikely.

What this means for you, in plain language

If you had TPS: the protection and the work permit that came with it are over. That doesn't mean every option is gone — asylum, family-based paths, and other relief exist for some people. Which ones fit your situation is a question for a licensed immigration attorney, not this page.

Don't pay a "notario" or paperwork person who promises to fix this. The notario scam feeds on exactly this kind of fear. Read our guide before giving anyone money: notario fraud explained.

Keep your documents organized and your know-your-rights cards on you. Free wallet cards in English, French, and Creole are on the free downloads page.
